Mdluli case: SJC, CW withdraw application to avoid delaying litigation

Social Justice Coalition (SJC) & Corruption Watch (CW) have formally withdrawn their application to intervene in the matter brought by Freedom Under Law (FUL) against General Richard Mdluli and others.

FUL’s application aims to review and set aside the decisions taken to withdraw criminal and disciplinary charges against Mdluli, including the withdrawal of corruption charges.

“It has now come to our attention that should we continue with our intervention application, our involvement may be used to delay the main application. It is in the interests of justice that the matter be adjudicated as soon as possible,” said David Lewis, Executive Director of CW.

Last year the North Gauteng High Court interdicted Mdluli from discharging any function or duty as a member and senior officer of SAPS, pending the outcome of FUL’s review application. CW and the SJC filed a joint application for leave to intervene as co-applicants, in order to adduce new evidence in support of the relief claimed by FUL.

CW and SJC continue to view Mdluli as wholly unsuitable to hold one of the most senior law enforcement positions despite being tainted by accusations of serious criminal acts, and view the decisions taken to withdraw the charges against him as unsupportable.

“We are confident that FUL’s case, which has been supplemented since we first filed our papers, is watertight and should proceed without further delay.” added Phumeza Mlungwana General Secretary of the SJC.
