All our correspondence in the Sars matter

Corruption Watch has laid charges against South African Revenue Services (Sars) commissioner, Tom Moyane, as well as two senior Sars employees, Jonas Makwakwa and Kelly-Ann Elskie.

The latter two are charged with fraud and corruption and Moyane is charged with failing to act decisively on the findings of a report from the Financial Intelligence Centre (FIC), detailing the alleged wrongdoings of the pair. The charges against him relate to a contravention of the Prevention and Combating of Corrupt Activities Act (Precca), which imposes a duty to report knowledge or suspicion of corrupt transactions over R100 000 to the Directorate of Priority Crime Investigation, also known as the Hawks. It is an offence to not report such transactions,

Moyane is also charged with revealing the contents of the FIC report to Makwakewa and Elskie, another Precca contravention.

We have written twice to the Hawks, and most recently, to the Independent Police Investigative Directorate (IPID), expressing our concerns that the Hawks were not handling the investigation efficiently. We also requested IPID to enquire into the failure of the Hawks to properly investigate Makwakwa, Elskie and Moyane as well as their failure to provide us with information relating to any steps they have or have not taken in respect of our criminal complaints.
