Corruption Watch has written to the parliamentary standing committee on finance to request that, as the body that exercises oversight in respect of the South African Revenue Service (Sars), it urgently inquires into the secretive processes followed by Sars that have resulted in Jonas Makwakwa being cleared of all wrongdoing and returning to work.
Makwakwa is alleged to have committed acts of fraud and corruption while occupying a senior managerial position at Sars. He was suspended in mid-September 2016 on full pay, with his his girlfriend Kelly-Ann Elskie, after the Financial Intelligence Centre (FIC) flagged the pair for a number of suspicious transfers into their personal bank accounts. Elskie returned to work days before Makwakwa.
We also requested the finance committee to take note of the conduct of Sars commissioner Tom Moyane in informing the two of the FIC report. We submitted that his actions amounted to breaches of the FIC Act which attract criminal sanctions.
In December 2016 we laid criminal charges against Moyane, Makwakwa and Elskie. Accordingly, we requested that the finance committee engage with other relevant parliamentary committees to establish the reason for the Hawks’ and NPA’s delay in investigating the charges against Makwakwa, Elskie and Moyane.
